Terms and Conditions of the Master-Magic platform

1. Operator
The Master-Magic platform, available primarily through the master-magic.dev website, is operated by:

The Company is registered for VAT in the Czech Republic and for VAT purposes in relation to applicable cross-border transactions within the European Union.
Hereinafter referred to as the “Operator”, “Master-Magic”, “we”, “us” or “our”.
These Terms and Conditions govern the use of the Master-Magic platform, related services, AI features, cloud services and other products provided by the Operator.
2. What is Master-Magic
Master-Magic is a software platform that uses, among other technologies, artificial intelligence and enables users to create, modify, test, operate and manage digital projects.
Depending on the features currently available, Master-Magic may be used to create, for example:
- websites
- online stores
- SaaS applications
- ERP and CRM systems
- internal business applications
- administration systems
- database applications
- prototypes
- user interfaces
- source code
- and other digital projects
Master-Magic may also provide or gradually make available services such as Master Build (AI-powered project creation and modification), Master Cloud (cloud infrastructure and application hosting), Master Domains (connection of custom domains), Master Subdomains (projects hosted on subdomains provided by Master-Magic), Master Emailing (email and communication services), Master Storage & Database (database and storage services), and other features, integrations and services.
The scope of individual services may change as the platform continues to develop.
3. User account
Certain Master-Magic features require the creation of a user account.
The User is required to provide truthful and up-to-date information and to protect their login credentials against unauthorized use.
The User is responsible for activities carried out through their account where such activities result from their actions or insufficient protection of their access credentials.
Where there is reasonable suspicion of unauthorized access, the Operator may temporarily secure or restrict the account.
4. Business accounts
A User may use Master-Magic as an individual or on behalf of a company or another legal entity.
A person registering an account on behalf of a company confirms that they are authorized to act for that company or to use the service on its behalf.
Business customers must provide correct billing details, in particular company name, registered address, company ID and, where applicable, a valid VAT ID.
5. Plans and paid services
Master-Magic may provide both free and paid services.
The scope of features, number of credits, capacity, limits and price of individual plans are set out in the platform's current price list.
Paid services may be charged, for example:
- monthly
- annually
- based on actual usage
- through credits
- as a one-off payment
- or a combination of these methods
Before a purchase is confirmed, the User is shown the price and the basic parameters of the service being ordered.
6. Automatic renewal
Where automatic renewal is stated for a particular plan, the subscription renews automatically at the end of the relevant billing period.
The User may cancel automatic renewal through their account where this option is available, or by another method indicated on the platform.
Cancelling automatic renewal does not terminate an already paid period. The User may continue to use the service until the end of that period.
7. Master Credits
Certain operations may be charged through internal units referred to as Master Credits (“Credits”).
Credits may be used, for example, for:
- AI generation
- build operations
- project modifications
- AI models
- cloud operations
- database operations
- data storage
- media generation
- other computationally demanding services
The number of Credits required for individual operations may vary depending on the model used, the complexity of the operation and the technical resources consumed.
8. Credit consumption
AI operations may have different computational demands. Two seemingly similar operations may therefore consume a different number of Credits.
The User acknowledges that AI generation is not deterministic and that the result may not always match expectations.
Dissatisfaction with the result of an AI operation does not in itself give rise to a claim for the refund of consumed Credits.
Where a demonstrable technical error of the platform occurs, the Operator may, depending on the circumstances, restore Credits or provide other reasonable compensation.
9. Validity of Credits
The validity of Credits and the rules for carrying them over are governed by the plan or the terms applicable at the time they were obtained or purchased.
Free, bonus, marketing or promotional Credits may have a different validity period than paid Credits.
Credits:
- are not electronic money
- do not represent a bank deposit
- are not a financial product
- cannot be converted into cash
- cannot be transferred between accounts unless Master-Magic expressly states otherwise
10. Prices and VAT
The Operator is a VAT payer in the Czech Republic.
Prices will indicate whether they are stated inclusive or exclusive of VAT.
The tax treatment of a particular transaction is determined under applicable Czech and European tax legislation, the type of customer, their country and, where relevant, the validity of their VAT ID.
For Czech customers, VAT will be charged in accordance with applicable law.
For businesses registered for VAT in another EU member state, the corresponding cross-border supply regime may be applied where statutory conditions are met.
For B2C customers in other EU member states, VAT is determined under the rules applicable to electronically supplied services.
The User is responsible for the accuracy of the billing details and VAT ID provided.
11. Payments
Payments may be processed by the Operator or through an external payment service provider.
Master-Magic may support, for example:
- payment cards
- bank transfers
- electronic payment methods
- automatic payments
- other supported payment methods
Where an external payment service is used, certain data may be processed by the relevant payment infrastructure provider.
12. Invoicing
Following a paid transaction, the relevant accounting or tax document may be issued to the customer.
The customer is responsible for the accuracy of the details stated in their account.
Changes to billing details generally cannot be made retroactively on documents already duly issued, unless legislation or the specific situation requires otherwise.
13. Cancelling a subscription
The User may cancel their subscription.
Cancelling a subscription does not automatically delete the user account or created projects.
Unless stated otherwise, the paid plan remains active until the end of the billing period already paid for.
After that period the account may move to a free plan, where Master-Magic offers one. Features available only on a paid plan may subsequently be restricted.
14. Reactivating a subscription
The User may reactivate a paid plan after cancellation.
Where valid Credits or projects are retained on the account, they may become accessible again after the subscription is reactivated.
Reactivating a subscription does not automatically restore Credits that have already expired.
15. Master Cloud and application hosting
An AI Builder subscription and hosting a project in Master Cloud may be two separate services.
Cancelling Master Build therefore does not necessarily shut down an application running in Master Cloud, provided cloud services continue to be duly paid for.
This separation allows the customer to finish a project and then pay only for the services required to run it.
Specific Master Cloud conditions, capacity limits and prices are set out in the applicable plan.
16. Unpaid cloud services
If payment for Master Cloud or other continuously billed infrastructure is not duly made, the Operator may restrict or suspend the service.
The Operator may provide a grace period before cloud data is permanently deleted. The length of this period may depend on the type of service or plan.
During suspension, applications, databases, APIs, files or other cloud resources may not be publicly available.
17. Custom domains
Master-Magic may allow a customer-owned domain to be connected.
Ownership of such a domain remains with the customer or its registered holder.
The customer is responsible for:
- the validity of the domain registration
- DNS configuration where they manage it themselves
- the right to use the domain
- any third-party claims
Termination of the Master-Magic service does not transfer ownership of the customer's domain to the Operator.
18. Master subdomains
Master-Magic may provide free or paid subdomains under domains managed by the Operator.
Such a subdomain is not owned by the User.
The Operator may change, deactivate or withdraw a subdomain, in particular in the event of:
- breach of these Terms
- long-term inactivity
- infringement of third-party rights
- a security issue
- fraudulent conduct
- unlawful content
- technical or operational reasons
For critical or commercial projects we recommend using your own domain.
19. AI and generated content
Master-Magic uses artificial intelligence technologies.
AI may produce, for example:
- source code
- text
- database structures
- user interface designs
- configuration
- images
- documentation
- other digital content
AI outputs may contain errors. Master-Magic therefore does not warrant that every AI output will be error-free, secure, complete, unique, fit for a particular purpose, or compliant with all legal requirements of a specific industry.
Before deploying a project to a production environment, the User is responsible for reviewing and testing it.
20. Production deployment
Describing a project or feature as “production ready”, “ready for production” or similar means that the platform enables the creation of a project intended for production deployment.
It does not mean automatic legal, security, accounting, tax, regulatory or industry certification of the created project.
The User is responsible for the final review of their project before publication or commercial use.
21. Project ownership
Content, data, instructions and other materials provided by the User remain the User's.
To the extent permitted by applicable law and third-party rights, the User may use outputs created for their project for private and commercial purposes.
Master-Magic retains all rights to its own platform, infrastructure, technologies, system components, internal tools, trademarks and other elements of the service that are not a specific customer project.
22. User data
The Operator processes data necessary to provide the service in accordance with applicable law and the Privacy Policy.
Details of the categories of data processed, the purpose of processing, retention periods, infrastructure providers and data subject rights are set out in the separate Master-Magic Privacy Policy.
23. Use of data for AI
Customer data will not automatically be treated as public merely because it was entered into Master-Magic.
If the Operator were to use customer content for further development or training of its own AI models beyond what is necessary to provide the ordered service, such processing will be governed transparently by the relevant policies and applicable law.
Data may be technically processed by AI model and infrastructure providers where necessary to perform the requested operation.
24. External AI and cloud providers
Master-Magic may use third-party technologies to provide certain features, for example providers of:
- AI models
- cloud infrastructure
- databases
- data storage
- email services
- payment systems
- DNS and domain services
The availability of certain features may therefore depend on the availability of external technologies.
25. Service availability
The Operator strives for high availability of Master-Magic but does not guarantee uninterrupted 24/7 availability unless a separate SLA is agreed for a particular plan.
Temporary unavailability may occur, for example, due to:
- maintenance
- updates
- technical issues
- cyber incidents
- external infrastructure problems
- an AI provider outage
- force majeure
26. Beta and experimental features
Certain features may be marked as Beta, Preview, Experimental, Early Access or similar. Such features may be changed, restricted or removed.
The User should not rely on experimental features as the sole critical component of a production system without an appropriate fallback.
27. Prohibited use
Master-Magic must not be used, in particular:
- for unlawful activity
- to distribute malware
- for phishing
- for fraud
- to obtain access credentials without authorization
- to infringe copyright
- for unauthorized processing of personal data
- to compromise system security
- to circumvent the platform's security mechanisms
- to intentionally overload infrastructure
- to host content prohibited by law
28. Account suspension
The Operator may temporarily suspend an account or a specific service where there is reasonable suspicion of:
- a security incident
- fraud
- abuse of the service
- unpaid obligations
- a serious breach of these Terms
- unlawful activity
- a threat to infrastructure or other customers
Where the nature of the situation allows, the User will be informed.
29. Account deletion
The User may request permanent deletion of their account.
The Operator may apply a grace period before the account is permanently removed, during which the User may withdraw the deletion request. The recommended Master-Magic grace period is 30 days.
After it expires, the account and related customer data may be irreversibly deleted.
Certain data may be retained longer where required by law, in particular accounting, tax, security or other statutory obligations. Technical backups may be removed later according to the standard backup cycle.
30. Termination for breach of these Terms
In the event of a serious breach of these Terms, the Operator may suspend or terminate the account.
In the event of fraud, intentional abuse of the service or another serious breach, unused bonus or promotional Credits may be forfeited.
The treatment of paid Credits is always governed by applicable law and the specific circumstances of termination.
31. Responsibility for created projects
The User is responsible for the project they create and operate through Master-Magic. This includes in particular:
- content
- products
- the terms and conditions of their project
- protection of their customers' personal data
- cookies
- licences
- copyright
- security
- the legislative requirements of their industry
- tax and accounting obligations
Master-Magic is a technology tool and does not become the operator of the customer's business merely because the project was created or hosted through the platform.
32. Backups and export
The User is responsible for reasonable backup of critical business data unless a guaranteed backup service is stated in the applicable plan.
Where Master-Magic allows a project or data export, we recommend using it before terminating a paid service.
33. Liability of the Operator
The Operator is liable to the extent set out by applicable law.
The Operator is not liable for damage caused in particular by:
- incorrect use of an AI output
- modification of the project by the User
- a third-party service
- incorrect configuration by the customer
- unlawful content of the customer
- loss of access caused by the customer
- use of an experimental feature contrary to its purpose
insofar as such limitation of liability is permitted by applicable law.
Nothing in these Terms excludes liability that cannot be excluded or limited by contract under mandatory law.
34. Consumers
Where a User enters into a contract as a consumer, they are entitled to the rights arising from applicable Czech and European legislation.
No provision of these Terms is intended to limit the statutory rights of consumers.
For digital services and digital content, rights relating to withdrawal from the contract may be affected by whether the consumer expressly requested that provision of the service begin immediately before the statutory period expires and whether other statutory conditions were met. The specific consent mechanism will be presented at the point of order where relevant.
35. Complaints
In the event of a technical problem or a defect in a paid service, the User may contact Master-Magic customer support.
Complaints will be handled in accordance with applicable law. Consumers retain all statutory rights arising from defective performance.
36. Promo codes and bonuses
Master-Magic may provide promotional codes, discounts, bonus Credits or other marketing offers. Each offer may have its own:
- validity period
- target group
- minimum purchase amount
- usage restrictions
- maximum number of uses
Promotional offers cannot be combined unless expressly stated otherwise.
The Operator may cancel a promotional code in the event of demonstrable abuse, fraud or technical error.
37. Changes to the platform
Master-Magic is an actively developed technology platform. The Operator may add, modify or remove features.
For material changes to a paid service that have a significant adverse impact on Users, the Operator will act in accordance with applicable law and contractual obligations.
38. Changes to these Terms and Conditions
These Terms and Conditions may be reasonably updated, particularly in connection with:
- new features
- changes in legislation
- security requirements
- infrastructure changes
- new Master-Magic products
Users will be informed of material changes in an appropriate manner before they take effect, unless applicable law permits or requires a different procedure.
39. Governing law
These Terms and Conditions are governed by the laws of the Czech Republic.
This does not affect consumer rights arising from mandatory provisions of applicable law.
40. Dispute resolution
The parties will first attempt to resolve any disputes amicably.
Consumers may also have the right to use out-of-court consumer dispute resolution through the competent authority under applicable Czech law.
For business-to-business relationships, disputes will be resolved by the courts of the Czech Republic having subject-matter and territorial jurisdiction, unless mandatory law provides otherwise.

42. Final provisions
If any provision of these Terms is found to be invalid or unenforceable, this will not in itself affect the validity or enforceability of the remaining provisions.
By using Master-Magic or ordering a paid service, the User confirms that they have read and agree to these Terms in the manner specified by the platform.
